EPA Issues Proposed Final WOTUS Rule Aligned With Supreme Court

The EPA released a proposed final Waters of the United States (WOTUS) rule that reflects the Supreme Court’s 2023 interpretation of Clean Water Act jurisdiction — a major win for farmers nationwide.

The updated rule removes unnecessary federal oversight of features like ditches, farmed wetlands, and dry creek beds, which previously created confusion and regulatory risk for producers.

NPPC President Duane Stateler applauded the decision, noting that producers have spent decades fighting overreaching and unclear WOTUS definitions. NPPC will submit official comments and continue monitoring the process.

The updated rule provides long-needed clarity and helps shield producers from permitting burdens and activist litigation.

Lawmakers Urge USTR to Proceed Carefully With USMCA Review

Over 100 members of Congress urged the U.S. Trade Representative to “carefully” evaluate any changes during the upcoming USMCA review, citing the agreement’s strong benefits to U.S. agriculture.

NPPC joined more than 125 ag and food groups in warning that adjustments to USMCA should not disrupt trade flows or create market instability.

More than 25% of U.S. pork is exported, with Mexico and Canada holding key positions as the first and fourth largest export markets. Certainty in these markets remains crucial during a time of economic pressure.
